Services may include artificial intelligence, automation, voice technology and third-party software platforms.

We reserve the right to modify, improve or discontinue any aspect of our services at any time.

While we strive to provide reliable services, artificial intelligence and automated systems are not error-free and may occasionally produce inaccurate or unexpected responses.

3. User Responsibilities

By using our services, you agree to:

• Use our services only for lawful purposes.
• Not misuse, interfere with or disrupt the services.
• Comply with all applicable laws and regulations.

You remain solely responsible for how our services are used within your business.

If you use our AI systems to communicate with your own customers or leads, you are solely responsible for ensuring compliance with all applicable privacy, marketing and telecommunications laws, including obtaining any required consent before contacting individuals.

You may not use our services for:

• Sending spam or unsolicited communications.
• Contacting individuals without any legally required consent.
• Fraudulent, misleading or unlawful activities.
• Any activity that violates applicable laws or regulations.

3.1 No Professional Advice

Our services, including AI-generated communications and automations, are provided for operational purposes only and do not constitute legal, financial, accounting, tax or other professional advice. Customers remain responsible for reviewing and approving communications where appropriate.

4. Consent to Communication

We use phone calls, SMS messages and email communications to respond to enquiries, schedule demonstrations, provide support and deliver our services.

By submitting your information through our website or otherwise engaging with us, you consent to receive communications from Growthline Systems, including:

• Phone calls (including AI-assisted or automated voice calls where applicable)
• SMS/text messages
• Emails related to your enquiry or our services

Message Information

• Message frequency may vary.
• Message and data rates may apply.
• Consent is not a condition of purchase.
• Communications are only sent where legally permitted.

Opt-out

You may opt out at any time by:

• Replying STOP to SMS messages.
• Replying HELP for assistance.

5. No Guarantee of Results

While our services are designed to improve responsiveness, lead management and operational efficiency, we do not guarantee:

• Specific revenue increases.
• A certain number of appointments.
• Business growth.
• Increased sales.
• Particular conversion rates.
• Uninterrupted availability of third-party services.

Results depend on numerous factors outside our control, including your business, market conditions, offer quality, pricing, sales process and customer demand.

6. Third-Party Services

Our services integrate with third-party providers, which may include:

• GoHighLevel
• Twilio
• Vapi
• Airtable
• n8n
• Calendly

We are not responsible for:

• Downtime
• Outages
• API changes
• Pricing changes
• Service interruptions
• Policies or practices of third-party providers

These providers process data under their own terms and privacy policies.

7. Payments & Fees

Where applicable:

• Fees will be agreed separately.
• Payments are non-refundable unless otherwise agreed in writing.
• Failure to pay may result in suspension or termination of services.

We reserve the right to charge interest on overdue invoices where permitted by law and recover reasonable collection costs.

7.1 Recurring Payment Authorization

By purchasing a recurring subscription, you authorize Growthline Systems to automatically charge your selected payment method for recurring subscription fees until cancelled in accordance with these Terms.

7.2 Fair Usage

Unless otherwise agreed in writing, monthly pricing assumes reasonable business usage. Exceptionally high call volumes or usage substantially exceeding expected levels may require an updated service plan. Growthline Systems will discuss any pricing adjustments with the customer before additional charges apply.

8. Intellectual Property

Unless otherwise agreed in writing, all software, workflows, automations, prompts, documentation, systems, website content and other materials provided by Growthline Systems remain our intellectual property.

You may not copy, reproduce, distribute, sublicense or resell our systems without prior written permission.

Unauthorized use may result in legal action.

Nothing in these Terms excludes or limits liability where such limitation is prohibited by applicable law.

9. Limitation of Liability

To the fullest extent permitted by law, Growthline Systems shall not be liable for:

• Indirect damages.
• Consequential damages.
• Loss of profits.
• Loss of revenue.
• Loss of business opportunities.
• Data loss.
• Downtime caused by third-party providers.
• AI-generated inaccuracies.
• Technical interruptions.

You are responsible for reviewing and approving any AI behaviour, workflows and automations before deploying them within your business.

Our total liability shall not exceed the amount paid by you for our services during the thirty (30) days immediately preceding the event giving rise to the claim.

10. Indemnification

You agree to indemnify, defend and hold harmless Growthline Systems from any claims, damages, liabilities, costs or expenses arising from:

• Your use of our services.
• Your violation of these Terms.
• Your violation of applicable laws.
• Your failure to obtain any legally required consent before contacting your customers or leads.
• Your misuse of our AI systems or automations.

11. Termination

We reserve the right to suspend or terminate access to our services if:

• These Terms are violated.
• Our services are misused.
• Required payments are not made.
• Continued use presents legal, operational or security risks.

12. Privacy

Your use of our services is also governed by our Privacy Policy.

13. Changes to these Terms

We may update these Terms of Service from time to time.

The updated version will be published on this page with a revised "Last updated" date.

Continued use of our services after changes become effective constitutes acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of Sweden.

14.1 Force Majeure

We shall not be liable for any delay or failure in performance caused by circumstances beyond our reasonable control, including but not limited to:

• Internet outages
• Telecommunications failures
• Government actions
• Natural disasters
• Cybersecurity incidents
• Third-party platform outages
